本文探讨了关于夫妻隐私权与忠实义务发生冲突时,应根据何种情况作出怎样的法律协调.文章开头是以案例的形式提出夫妻隐私权与忠实义务冲突存在的问题,在婚姻家庭中,是个人的隐私权重要还是夫妻的忠实义务处于首要地位.首先先逐个了解何为隐私权与夫妻忠实义务,分析了隐私权的概念、特征以及法律保护；其次再解释夫妻忠实义务的概念与法律保护.然后列举了隐私权与忠实义务可能存在的几种冲突；再对文章开头关于“婚外情”冲突理论分析,并对因“人肉搜索”引发的隐私权与忠实义务的冲突分析；对比两者均是因“婚外情”引起的隐私权与忠实义务的冲突,但结果却截然相反从而解释了对于两者的法律保护都有其限制范围.最后提出夫妻隐私权与忠实义务发生冲突时的法律协调应遵循的原则.

This article discusses the privacy and the duty of loyalty on the couples in conflict,and what circumstances should the legal coordination.Article at the beginning of the form of husband and wife are case Privacy duty of loyalty conflict with the existing problems in the marriage and family in the privacy of individuals or couples,the important duty of loyalty is top priority.First of all,one by one first to understand what privacy and Loyalty Obligations,analysis of the concept of privacy,features and legal protection; followed the couple to explain the concept of duty of loyalty and protection of the law.And then listed the possible privacy and duty of loyalty of several conflicts; longer article at the beginning of "extramarital affairs" conflict theory,and because of "human flesh search" duty of loyalty caused privacy and conflict analysis; contrast both is due to "affair" caused by the conflict privacy and duty of loyalty,but the result is opposite to explain the legal protection for both have their limits.Finally,marital privacy and duty of loyalty conflict when legal harmonization principles to be followed.
